The U.S. EPA finalized the Hazardous Waste Generator Improvements Rule (Improvements Rule) on October 28, 2016. On May 30, 2017, this rule goes into effect in states and territories without a RCRA-authorized hazardous waste program (Alaska, Iowa, the Indian Nations, and the territories Puerto Rico, American Samoa, Northern Mariana Islands, and U.S. Virgin Islands). The EPA will typically require RCRA-authorized states to adopt the more stringent provisions of the Improvements Rule by July 1, 2018. These states need not adopt provisions that are less stringent than current hazardous waste regulations.
Changes to the BLR federal regulatory analysis for this topic and others affected by the Improvements Rule are being made and will be online before May 30, 2017. Changes to parallel state regulatory analyses will be made as states revise their regulations to comply with the new rule. Until then, RCRA-authorized states will follow their current hazardous waste regulations.
