The NPDES permit program was established under Section 402 of the CWA. This important EPA regultory area prohibits the unauthorized discharge of pollutants from a point source (pipe, ditch, well, etc.) to U.S. waters, including municipal, commercial, and industrial wastewater discharges and discharges from large animal feeding operations.

NPDES permits establish effluent limitations for pollutants that determine what can be discharged and how much. Once you have a NPDES permit, you are required to verify compliance with permit requirements by monitoring their effluent, maintaining records, and filing periodic reports.

States that are not authorized by EPA to administer the NPDES permit program may implement water pollution control permit programs independent of and in addition to the federal program. Consequently, a discharger in an unauthorized state may be required to submit two permit applications—one to the federal program and one to the state program.
