Delisting Petitions
National Summary
Delisting is a procedure by which facilities can be relieved of the obligation to handle specific wastes as hazardous. EPA defined these wastes as hazardous by listing them in 40 CFR 261, Subpart D. However, a specific facility might generate a waste that does not exhibit any characteristics for which it was listed. To avoid placing an unnecessary burden on such facilities, RCRA provides a petition process for case-by-case exclusions or "delistings" of specific wastes from the hazardous waste lists.
